Cubby Toy Library Membership Terms

By becoming a member of The Cubby Toy Library, you agree to the following terms:

  1. Borrowing Items
    I agree to return all borrowed items within the 2-week borrowing period.

  2. Item Limits
    I understand that membership allows me to borrow up to 8 items, regardless of their size.

  3. Item Condition
    I agree to return items in clean and hygienic condition.

  4. Volunteering
    I agree to volunteer for at least 8 hours to help run the Toy Library, unless I opt for a non-duty or organisational membership.

  5. Stocktake & Cleaning
    I agree to attend stocktake and cleaning sessions at the end of the year, if required by my membership type.

  6. Contact Information
    I agree to notify the Toy Library of any changes to my contact details.

  7. Damages & Loss
    I agree to pay for any damages or losses of items while they are in my possession, as determined by The Cubby Toy Library.

  8. Missing Parts
    I understand it’s my responsibility to ensure all parts of an item are returned and to notify the Toy Library of any missing parts immediately. Missing parts incur a $5 fee per item, or full replacement costs for puzzles and dress-ups.

  9. Item Selection & Supervision
    I understand that I must select appropriate items for my child and supervise their use. I’m also responsible for ensuring that small pieces in toys are kept safe and out of reach of young children.

  10. Safety Helmets
    I understand that helmets are not provided with scooters and bikes, and I am responsible for any injuries that may occur during their use.

  11. Revocation of Borrowing Privileges
    I understand that my borrowing privileges may be temporarily or permanently revoked if:

    • I fail to return items on time

    • I fail to pay for lost or damaged items

    • I consistently return items that are not cleaned

    • I fail to pay my membership in full

    • I don’t fulfill my volunteer duties or attend cleaning sessions

  12. Liability Waiver
    I acknowledge that I won’t hold The Cubby Toy Library responsible for any accidents, injuries, or losses that occur due to borrowed items, even if caused by the Library’s negligence. I agree to indemnify The Cubby Toy Library from any claims related to the borrowing program.

  13. Personal Information
    I agree that my personal information will be shared with the Committee Members of The Cubby Toy Library and displayed on the member roster.

  14. Email Communication
    I agree to receive emails, including meeting notices, from The Cubby Toy Library. I will check my emails regularly to stay updated on any important information.

  15. Failure to Complete Duties
    I understand that if I fail to complete my volunteer duty or stocktake, I may forfeit part or all of my duty levy.


 


Helmet Waiver – The Cubby Toy Library (Shepparton)

The Cubby Toy Library ("Provider") offers bicycles and scooters to subscribers ("the Service"). By using the Service, you acknowledge that bicycle and scooter use ("the Activity") involves risks, including injury or death to any child under your care ("Your Child").

The Provider does not supply helmets or protective gear. You are solely responsible for ensuring Your Child wears a helmet and appropriate clothing during the Activity. Participation is at your own risk, and you accept full responsibility for supervising Your Child and any resulting injury, damage, or loss.

To the fullest extent allowed by law, you (on your own behalf and on behalf of Your Child) release and indemnify the Provider and its staff, agents, and contractors (“Indemnified Persons”) from all claims, liabilities, or damages arising from the Service or the Activity.

You agree the Provider:
(a) is not liable for any injury, death, or property damage suffered by you, Your Child, or any related person due to participation in the Activity; and
(b) is not responsible for any loss or damage to property belonging to you, Your Child, or any related person.

The Provider is also not liable for any indirect or consequential loss, including but not limited to loss of profits, opportunity, goodwill, or reputation.


 


 

Child Safety Code of Conduct
Applicable to all members, volunteers, and visitors

All personnel are required to observe child-safe principles and uphold appropriate standards of behaviour toward, and in the presence of children.

This includes the following expectations:

Commitment to Child Safety

All individuals are responsible for supporting the safety, wellbeing, participation, and empowerment of children by:

  • Adhering to the organization's Child Safe Policy and Statement of Commitment to Child Safety at all times

  • Taking all reasonable steps to protect children from harm or abuse

  • Treating all children with respect, regardless of background or ability

  • Listening to and responding to children’s views and concerns—especially if they raise safety issues or disclose abuse

  • Promoting the cultural safety, inclusion, and empowerment of children from diverse backgrounds by maintaining zero tolerance for discrimination

  • Supporting the safety and inclusion of children with disabilities (e.g., during personal care)

  • Ensuring, wherever practicable, that adults are not alone with a child

  • Promptly reporting any allegations or concerns regarding child abuse to the designated Child Safety Officer or organizational leadership, and ensuring appropriate authorities (police or child protection) are notified where required

  • Taking immediate action to protect children if an allegation of abuse is made

Unacceptable Behaviour

Members, volunteers, and visitors must not:

  • Form ‘special’ relationships with children that may be perceived as favoritism (e.g., gift-giving or special treatment)

  • Display behaviours that could be construed as unnecessarily physical (e.g., inappropriate lap-sitting — note: some contexts like reading to a young child in a public area may be appropriate)

  • Put children at risk of harm (e.g locking doors while alone with a child)

  • Discuss mature or adult topics in the presence of children (e.g personal social activities)

  • Use inappropriate or offensive language in the presence of children

  • Express personal views on culture, race, gender, or sexuality in front of children

  • Discriminate against any child based on their culture, race, ethnicity, gender, or ability

  • Have online contact with a child or their family unless it is necessary for organizational purposes (e.g distributing newsletters)

  • Ignore or fail to report suspected or disclosed child abuse

Reporting and Responsibility

By following this Code of Conduct, you acknowledge your obligation to report any breaches of these standards to the designated Child Safety Manager or leadership team.
